Austrian Woman Found Guilty of Fatally Infecting Neighbor with COVID-19

In a notable case in Austria, a woman was convicted for the death of her neighbor due to COVID-19. The 54-year-old was sentenced on Thursday to four months of suspended imprisonment and an 800-euro fine for grossly negligent homicide.

The incident dates back to 2021, when the victim, a cancer patient, succumbed to pneumonia caused by the coronavirus. According to reports from the Austrian news agency APA, virological evidence revealed that the viral DNA from both the victim and the defendant matched. An expert asserted in court that it was “almost 100 percent” verified that the woman transmitted the virus to her neighbor.

During the sentencing, the judge expressed sympathy, noting that such cases might have occurred numerous times during the pandemic. “I feel sorry for you personally,” the judge remarked. “But you are unlucky that an expert has determined with almost absolute certainty that it was an infection that came from you.”

While the judge pronounced the sentence, the verdict is not yet final, as reported by APA. Austrian privacy regulations prevented the release of the names of both the victim and the defendant involved in the case.

This recent conviction marks the woman’s second pandemic-related offense. Last summer, she faced legal action for intentionally endangering public health through communicable diseases, for which she received a three-month suspended sentence. However, during that earlier trial, the grossly negligent homicide charge was dismissed.

In the current case, the court heard testimony from the victim’s family. They indicated that the neighbors had interacted in their building’s stairwell on December 21, 2021, at a time when the defendant was already aware that she had COVID-19. The woman, however, refuted the family’s claims, asserting that she was too ill to leave her bed that day. She claimed to be suffering from bronchitis, a condition she typically wrestles with each year.

Contradicting her account, the woman’s physician informed the police that she had tested positive for COVID-19 through a rapid test and mentioned that she refused to adhere to quarantine measures, stating, “I certainly won’t let myself be locked up” after receiving the result.

This case reflects the serious consequences of neglecting public health guidelines, especially in the context of the ongoing pandemic. The legal system’s handling of such matters underscores the importance of individual responsibility in preventing illness transmission and protecting vulnerable populations.
