Attorney says Don Lemon’s case against Elon Musk ‘should settle’

  • ‘The Don Lemon Show’ was canceled before the first episode aired
  • Elon Musk, his business partner, called off deal after uncomfortable chat

Former CNN anchor Don Lemon is suing Elon Musk, the owner of X, after a TV deal for “The Don Lemon Show” was axed before its first episode aired. Lemon accuses Musk of fraud, misappropriation of his name and likeness, negligent misrepresentation, and breaching an express contract. The first episode was supposed to feature an interview with Musk, but tension and challenging questions marked their conversation, leading Musk to call off the deal via text with the message “contract is canceled.”

The lawsuit brings to light the fact that there was no written contract for the show. Civil litigator and attorney Richard Schoenstein mentioned this lack of documentation would complicate Lemon’s case. Lemon claims Musk used his “name, likeness, identity, and reputation” before breaking their “express agreement” and failing to provide compensation. Schoenstein pointed out that without written proof, proving a breach of contract would be more difficult.

However, Schoenstein noted that Lemon’s allegations might still hold weight despite the absence of a written contract, potentially posing an issue for Musk. Another significant point in Lemon’s lawsuit is his claim that he was never paid the anticipated $1.5 million per year and that he invested his own money into the project. Schoenstein commented that if a partnership did indeed exist and Lemon invested money, recovering that investment seemed straightforward.

Overall, the lawsuit has kept both Lemon and Musk in the media spotlight. Schoenstein suggested that the dispute might end with a settlement, although the celebrities’ statuses could influence the outcome.
