Halle Berry in Major Custody Battle as ‘The Union’ Hits Netflix

The two actors split in 2015 and have had court battles ever since.

The battle between Halle Berry and her ex-husband, Olivier Martinez, seems to have no end. Just weeks after Berry raised concerns in court about Martinez delaying co-parenting therapy for their 10-year-old son, Maceo, TMZ reports that the Oscar winner has now filed for sole physical and legal custody of the boy. Berry and Martinez divorced in 2015 after two years of marriage. Although their divorce was finalized just last year, they currently share joint physical and legal custody of Maceo. However, Berry contends that Martinez does not take Maceo’s behavioral issues seriously and prioritizes his soccer practices over other important aspects of his upbringing.

Berry says she has attempted private mediation but has been compelled to go public with her legal filing because of Martinez’s unwillingness to come to a mutual agreement. She attributes Martinez’s “turbulent and detrimental behavior” as having a negative impact on their son, resulting in both behavioral and learning difficulties for Maceo.

Maceo is reportedly facing challenges in school. Berry claims that when she suggested to Martinez that he get a tutor for Maceo during his time with him, Martinez refused, citing the boy’s rigorous soccer schedule. According to Berry, when Maceo returns to her custody, he exhibits combative behavior, which she believes stems from their disagreements over parenting approaches.

Berry believes that obtaining sole custody is the only way to properly address Maceo’s needs. She seeks to have the authority to make decisions related to his education and therapy independently, without the need for Martinez’s input.

Earlier this August, Berry stated that both she and Martinez had agreed to attend co-parenting therapy sessions to resolve their issues. However, these sessions were delayed by Martinez until September, as he wanted to take the “summer off.” Given that the sessions are conducted on Zoom, Berry found it hard to accept any scheduling conflicts that Martinez might have cited.

Following their 2015 split, Berry was ordered to pay Martinez a reported $8,000 a month in child support, along with “4.3% of any income she receives above $2,000,000” in additional support. Berry also covers their son’s private school tuition, uniforms, school supplies, and extracurricular activities, according to PEOPLE.
