A Harrison resident, Caroline Freebern, has filed suit in Westchester Supreme Court against celebrity cosmetic surgeon Dr. Steven T. Greenberg and his practice, Greenberg Cosmetic Surgery and Dermatology, seeking $172,250 for what she claims is a refusal to issue a refund after a canceled cosmetic procedure.
In the complaint lodged on June 13, Freebern accuses Dr. Greenberg and his practice—widely promoted as New York’s top choice for facial treatments—of fraud and causing her “severe mental distress, depression, anxiety, and humiliation.” The lawsuit alleges that the well-known medical group not only failed to issue her a refund for an unperformed procedure, but also pressured her to pay the full amount up front after initially promising to help her secure a bank credit plan.
According to court documents, Freebern agreed in June 2023 to pay $62,250 for a cosmetic procedure at Greenberg’s practice. The procedure was scheduled for July 13, 2023, but ultimately was not performed. Despite the cancellation, the complaint states the practice refused to provide a refund. It remains unclear which specific procedure Freebern had scheduled, why it was canceled, or who exactly decided to call it off.
Dr. Greenberg is frequently promoted as “New York’s celebrity cosmetic surgeon” on the practice’s official site. Greenberg Cosmetic Surgery and Dermatology maintains offices in both Woodbury, Nassau County, and Scarsdale. The lawsuit claims the practice and its doctor acted maliciously, breached their duty of good faith and fair dealing, and engaged in fraudulent behavior financially benefitting from Freebern’s payment while concurrently inflicting emotional trauma.
Freebern’s suit seeks a refund of the full $62,250 paid, $100,000 in punitive damages, as well as $10,000 in legal fees. She is represented by attorney Gary A. Cusano of Bedford Hills.
As of publication, Greenberg Cosmetic Surgery and Dermatology did not respond to requests for comment issued through its official website.

Refund disputes and breaches of contract in the context of elective cosmetic procedures are not unprecedented. Patients sometimes allege improper conduct or financial impropriety when scheduled surgeries are cancelled, and New York courts have seen similar claims brought forward, such as disputes over refunds and emotional harm following cosmetic procedures.
For individuals considering elective surgery, it is vital to review the terms and conditions outlined in surgical and financial agreements. Additional information on patients’ rights and recommended steps for legal recourse following medical disputes is available through trusted resources like the New York State Department of Health and the American Society of Plastic Surgeons.
While lawsuits against high-profile surgeons attract headlines, every case depends on its specific circumstances. As this situation evolves, updates are expected from both the court and, potentially, Dr. Greenberg and his practice.
