Hunter Biden is facing the possibility of becoming the first child of a sitting president to be imprisoned as he awaits sentencing for gun and tax charges. The sentencing for the gun charges is scheduled for November 13, and the tax charges will be addressed on December 16. While the maximum potential sentences could reach a combined total of over 40 years, legal experts suggest that he is likely to receive a much lighter sentence as a first-time offender.

The legal troubles for Biden, 54, stem from nearly five years of federal investigations. In a recent court proceeding, he pleaded guilty to nine counts related to failing to pay taxes from 2016 to 2019. Earlier this year, he was convicted on three gun charges, where harrowing accounts of his battle with crack cocaine addiction were presented. He opted for a surprise plea deal on the tax charges to spare his family from further distress.

Biden is now faced with the stark reality of sentencing, which could theoretically impose up to 25 years for the gun charges and 17 years for the tax charges. This comes after a previous plea agreement, which would have allowed him to escape prison time altogether, fell apart in July 2023.

Shanlon Wu, a former adviser to Attorney General Janet Reno, expressed skepticism about the possibility of a heavy prison sentence for Biden. “Given the circumstances, I think we should expect a relatively light sentence,” he noted, adding that alternatives such as probation or home confinement are plausible outcomes.

Legal representatives for Biden are expected to emphasize his journey to recovery, repayment of overdue taxes even before charges were filed, and argue that there is no need for deterrent punishment since he has already taken significant steps towards addressing his past mistakes.

Julian Andre, a former federal prosecutor, pointed out that Biden’s addiction issues were central to his legal difficulties. He suggested that at the sentencing, Biden’s legal team would likely argue for probation based on the premise that he has been held to a more severe standard due to his familial connections to a presidential figure.

In the backdrop of the legal proceedings, Biden’s lawyers contend that the prosecution’s decision to pursue additional charges after the plea agreement’s collapse was politically motivated. They argue that the investigation led by special counsel David Weiss was influenced by external political pressures. Weiss, however, has denied these claims before Congress.

Legal expert Carl Tobias highlighted the concern that the attention this case has garnered might lead judges to impose stricter sentences, given the public pressure surrounding it. Yet, Andre argued that it would be inappropriate for either court to hand down excessive sentences simply because of Biden’s well-known background.

Biden’s gun charges stem from his alleged misrepresentation of his drug history when purchasing a firearm in 2018. Experts pointed out that such charges are rare unless linked to violent criminal behavior. Furthermore, the tax issues typically do not lead to prosecution if the owed taxes are paid back in a timely manner.

After entering his guilty pleas, Biden expressed frustration at being unable to disclose in court that he had repaid his taxes and associated penalties back in 2021. Without this context, he feels his actions were misrepresented. However, prosecutors have opposed sharing this information in court, fearing it could undermine future enforcement of tax laws.
