Hutchins’ Widower Vows to Sue Alec Baldwin Again for ‘Rust’ Cinematographer’s Death

EXCLUSIVE: Alec Baldwin has recently witnessed the abrupt dismissal of the involuntary manslaughter case against him for the fatal 2021 shooting of Rust cinematographer Halyna Hutchins. However, the Emmy-winning actor might be back in court sooner than he anticipated.

Almost two years after Baldwin and Rust producers reached a settlement with Hutchins’ estate and her grieving husband, the lawyer for Matthew Hutchins made it clear that circumstances have changed.

“We respect the court’s decision,” Brian J. Parish told Deadline. “We look forward to presenting all the evidence to a jury and holding Mr. Baldwin accountable for his actions in the senseless death of Halyna Hutchins,” the Panish | Shea | Ravipudi LLP attorney added.

Whether this court appearance will continue from the initial wrongful death action filed in February 2022 or take the form of a breach of agreement suit remains unclear.

Hutchins lost her life, and Rust director Joel Souza was injured on October 21, 2021, when a Colt .45 Baldwin pointed at the cinematographer discharged a live round during a rehearsal at the Bonanza Creek Ranch near Santa Fe. Baldwin, re-charged with involuntary manslaughter in January, exactly a year after the first charge, entered a not guilty plea in the weeks that followed.

Facing up to 18 months in state prison if found guilty, Baldwin has always maintained that while he cocked the hammer, he did not pull the trigger, suggesting the gun went off on its own. The FBI and others contradicted this claim, but the point may now be moot. Three days into his criminal trial, Judge Mary Marlowe Sommer dismissed all charges with prejudice over critical evidence that had been supposedly concealed.

With the agreed-upon funds due to Hutchins’ estate not having been paid by the Rust team as scheduled and now being months behind, this situation could become very messy for Baldwin again. The February 2022 wrongful death suit is still open in the New Mexico courts as various defendants and insurance companies continue to argue in the docket.

Resurrected in early 2023 and completed filming in Montana, the now-finished Rust, with Matthew Hutchins as an executive producer, has still yet to find a buyer.
