Judge Stops NY AG James from Targeting Pregnancy Centers Over Pill

This week, a federal judge granted a preliminary injunction that prevents New York Attorney General Letitia James from taking action against pregnancy clinics, citing concerns about free speech restrictions.

Judge John L. Sinatra, Jr., who was appointed by former President Trump, stated, “In sum, on this record, Plaintiffs have standing. No abstention doctrine applies. And no other prudential, discretionary or equitable obstacle to such relief exists.” He further elaborated that the plaintiffs’ claims related to the First Amendment were significant enough to merit the granting of the motion for a preliminary injunction.

Under this order, James, in her official capacity along with her agents, employees, and any others working with her, is prohibited from enforcing consumer fraud laws against certain organizations. These include the National Institute of Family and Life Advocates, Gianna’s House, Inc., and Choose Life of Jamestown Inc. The injunction specifically addresses their rights to discuss and promote the abortion pill reversal procedure.

Previously, Attorney General James had sued Heartbeat International and 11 centers for allegedly promoting the abortion pill reversal method. She accused these groups of committing fraud, engaging in deceptive business practices, and spreading misinformation regarding abortion procedures. James asserted that these organizations were misleading patients by advertising without scientific backing.

Medicinal abortion typically involves taking mifepristone followed by the medication misoprostol. However, some pregnancy centers have advised individuals who wish to continue their pregnancies that they can avoid the second medication and instead take progesterone supplements. Nonetheless, medical authorities like the American College of Obstetricians and Gynecologists have asserted that the safety and effectiveness of this approach lack adequate support.

The court’s injunction will remain effective until the case is resolved. It specifically applies to the organizations named in the ruling and is supported by the Alliance Defending Freedom (ADF), which views the ruling as a significant victory for the plaintiffs.

Caleb Dalton, a senior counsel for the ADF, expressed that the court rightly upheld the centers’ rights to inform women about what he referred to as a life-saving treatment option. Dalton also represented the plaintiffs before the court during the proceedings.

The lawsuit highlighted allegations against the attorney general for targeting these organizations because of their opinions relating to the abortion pill, a topic that has sparked considerable debate and legal challenges in recent months. Similar developments have unfolded in Colorado, where legal battles over the same issue resulted in an injunction as well.

In a broader context, U.S. District Judge Daniel Domenico, another Trump appointee, previously ruled that banning the abortion medication violated constitutional rights, linking the decision to the First Amendment and the protections offered under religious freedom.

As developments continue to unfold, the New York Attorney General’s office has not yet provided a public response regarding this particular court ruling.
