Federal judges rule that transgender care policies in West Virginia and North Carolina are discriminatory

A federal appeals court ruled Monday that West Virginia and North Carolina’s refusal to cover certain health care for transgender people with government-sponsored insurance is discriminatory. The ruling by the 4th U.S. Circuit Court of Appeals stated that the coverage exclusions are not related to an important government interest. This decision follows a previous ruling that West Virginia’s transgender sports ban violates Title IX. West Virginia Attorney General plans to appeal the health care case ruling. North Carolina is still reviewing the decision. The cases are likely to reach the U.S. Supreme Court. West Virginia and North Carolina have differing policies on gender-affirming care.
