Prosecutors decide not to pursue retrial for Arizona rancher accused of killing Mexican man near U.S.-Mexico border

Prosecutors announced they will not retry Arizona rancher George Alan Kelly for the fatal shooting of a Mexican man, following a deadlocked jury. The Santa Cruz County Attorney’s Office decided not to seek a retrial due to the unique circumstances of the case. Judge Thomas Fink agreed to dismiss the case, with a hearing scheduled to determine if it would be dismissed with prejudice. Kelly expressed relief after the decision. Protesters demonstrated on behalf of the victim, Gabriel Cuen-Buitimea. Kelly had been charged with second-degree murder for the killing outside Nogales, Arizona. The trial took place amidst border security discussions during a presidential election year.
